Introduction

These Terms & Conditions ("Terms") govern your access to and use of the MyCare website, mobile applications, and related services (collectively, the "Service") provided by Syntext Inc. ("MyCare," "we," "us," or "our"), located at 1212 Highland Ct, Iowa City, IA 52240. By creating an account or using the Service, you agree to be bound by these Terms.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of another person as a caregiver, you represent that you have the authority to do so.

Accounts

To use most features of the Service, you must create an account. You agree to provide accurate information, keep it up to date, and keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at legal@syntext.io if you suspect any unauthorized use of your account.

Your Content

You retain ownership of the journal entries, notes, and other content you submit to the Service ("Your Content"). You grant MyCare a limited, worldwide, non-exclusive license to host, store, process, and display Your Content solely to operate, secure, and improve the Service for you. You are responsible for Your Content and represent that you have the rights to share it with us.

Ask MyCare AI

The Service may surface insights, summaries, and suggestions generated using artificial intelligence. These outputs may be incomplete or incorrect, and should not be relied on as medical advice. You are responsible for evaluating AI-generated content and should always consult a qualified healthcare provider before acting on it.

Privacy & Security

We take the security of your information seriously. Data is encrypted at rest using AES-256 and in transit using TLS. Sessions automatically time out after inactivity, and accounts are protected against brute-force sign-in attempts via temporary lockouts. Our handling of personal information is described in our Privacy Policy.

Acceptable Use

You agree not to:

• Use the Service in any unlawful manner or for any unlawful purpose;
• Attempt to gain unauthorized access to the Service or other users' accounts;
• Interfere with or disrupt the integrity or performance of the Service;
• Use the Service to provide medical advice, diagnosis, or treatment to others;
• Reverse engineer, scrape, or otherwise misuse the Service.

Subscriptions, Billing & Refunds

MyCare is offered on a paid subscription basis with a 7-day free trial. Two plans are available:

• Monthly plan — $9 USD per month, billed monthly.
• Annual plan — $99 USD per year, billed yearly (equivalent to one free month versus the monthly plan).

Free trial. When you start a paid plan, you receive a 7-day free trial. You will not be charged if you cancel before the trial ends. If you do not cancel before the trial ends, your selected plan will automatically begin and your payment method will be charged at the applicable rate above.

Auto-renewal. By starting a paid plan, you authorize us (or our payment processor) to charge your payment method on a recurring basis (monthly or annually, depending on the plan you select) until you cancel. Subscriptions automatically renew at the then-current rate at the end of each billing period unless cancelled beforehand.

Cancellation. You may cancel at any time from your account settings. Cancellations take effect at the end of your current billing period; you will continue to have access to paid features until then.

Refunds. Except where required by applicable law, paid subscription fees are non-refundable once the billing period has begun. You will not be charged for cancellations made during the free trial. Price changes will be communicated in advance and will only apply to future billing periods.

Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or to protect the Service or its users.

Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. MyCare does not warrant that the Service will be uninterrupted, error-free, or completely secure.

Limitation of Liability

To the maximum extent permitted by law, MyCare and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising out of or in connection with your use of the Service.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Johnson County, Iowa.
